Advercado User Agreement

Welcome to Advercado.co.uk (“Advercado”, “we”, “our” or “us”). By using our platform, you (“you”, “user”, “vendor”, or “customer”) agree to the terms set out in this User Agreement.
Advercado is an open marketplace connecting businesses and individuals who want to buy advertising spaces and services with vendors who provide them. As an intermediary, we aim to protect both sides, while making it clear that all parties share responsibility for maintaining a fair, safe and lawful environment.
1. General Responsibilities
1.1. Vendors are responsible for delivering the services or advertising space agreed upon in a professional, timely manner.
1.2. Customers are responsible for providing clear, lawful and appropriate instructions, content and materials for their order.
1.3. Advercado acts only as a facilitator. We do not create, produce or guarantee the quality of any work delivered by vendors, nor the behaviour of customers.
2. Dispute Resolution Procedure
Because this is an open marketplace, disagreements may arise. Our goal is always to encourage a mutually beneficial resolution.
2.1. If an issue occurs, the customer and vendor must first attempt to resolve it directly through the platform’s messaging system.
2.2. If no agreement is reached within a reasonable timeframe, either party may escalate the matter to Advercado’s Dispute Team.
2.3. The Dispute Team will review all evidence, including communications, drafts, and agreements.
2.4. Outcomes may include (but are not limited to):
- A partial refund and partial payment.
- Revision or correction of the work by the vendor.
- Cancellation of the order.
2.5. Important: Customers cannot use, publish or benefit from any work delivered by a vendor unless an agreement is reached. If a project is cancelled, all rights to the work remain with the vendor.
3. Refunds and Cancellations
3.1. Refunds are only available in the following circumstances:
- The vendor fails to deliver the service or advertising space as agreed.
- Both parties agree to cancel the order and request a refund.
3.2. Refunds are not available if:
- The customer provides content that is illegal, misleading, offensive, pornographic, discriminatory, or otherwise in breach of UK advertising standards or Advercado’s values.
- A conflict of interest is identified by the vendor.
3.3. In such cases, the vendor has the right to refuse the order without refund. Any goodwill refunds remain at the vendor’s discretion.
4. Content Standards
4.1. Customers must ensure that all content provided is:
- Legal and compliant with UK law and ASA (Advertising Standards Authority) guidelines.
- Appropriate for public use and not harmful, defamatory, offensive or misleading.
4.2. Vendors may reject and report any content that breaches these standards.
5. Intellectual Property
5.1. Unless otherwise agreed in writing:
- Ownership of work transfers to the customer only once full or agreed payment is made.
- Until then, all rights remain with the vendor.
5.2. Customers may not use, publish, or distribute any vendor work without a clear agreement and payment.
6. Limitation of Liability
6.1. Advercado is not a party to contracts between customers and vendors and accepts no liability for disputes, loss of earnings, reputational damage, or unlawful use of advertising content.
6.2. Our role is to facilitate communication and provide a fair dispute resolution process, but final responsibility lies with the users of the platform.
7. Bans and Terminations
7.1. We reserve the right to suspend or permanently remove any user who:
- Repeatedly fails to deliver or pay.
- Provides unlawful or offensive content.
- Attempts to misuse or exploit the dispute system.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
